GENERAL TERMS AND CONDITIONS OF SALE — MUJA SURF CLUB

1. Purpose

These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the sale of products under the MUJA brand, operated by Muja Surf Club (hereinafter the “Seller”), via the Muja Surf Club website or any other sales channel, to any natural or legal person (hereinafter the “Customer”).
Any order placed with MUJA SURF CLUB implies full and unconditional acceptance of these GTC.

2. Products and Availability

The products offered for sale are surf hats and related accessories, presented on the website with their essential characteristics.
Some items may be offered for pre-order prior to their official availability.
Availability dates and delivery times are provided for indicative purposes only and may be subject to change due to production, supply, or transportation constraints.
In the event of prolonged unavailability of a pre-ordered product, the Customer will receive a full refund of the order.

3. Prices

Prices are indicated in euros (€), inclusive of all taxes (VAT included), excluding delivery costs.
MUJA SURF CLUB reserves the right to modify its prices at any time; however, the price applied shall be the one in effect at the time the order is confirmed.

4. Orders and Payment

The Customer selects the products they wish to purchase, confirms the order after reviewing the shopping cart, and proceeds with secure online payment.
Payment is due immediately upon ordering, including for pre-orders.
An order confirmation will be sent by email to the address provided by the Customer.

5. Delivery

Products are delivered to the address specified by the Customer at the time of ordering.
Delivery times are provided for indicative purposes only and may vary depending on the destination, the chosen shipping method, and product availability.                      MUJA SURF CLUB delivers to selected countries within the European Union.

6. Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise the right of withdrawal without providing any reason.
The product must be returned in its original condition, unworn, and in its original packaging.
Return shipping costs are borne by the Seller, except in cases of error attributable to the Customer.
The refund will be processed within 14 days after receipt of the returned product in compliant condition.

7. Warranties

MUJA SURF CLUB products benefit from:

  • the legal guarantee of conformity (Articles L.217-3 to L.217-20 of the French Consumer Code), and

  • the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

8. Liability

MUJA SURF CLUB shall not be held liable for indirect damages resulting from the use or storage of the products.
In any event, the Seller’s liability shall be limited to the total amount paid by the Customer.

9. Force Majeure

The Seller shall not be held liable for any failure or delay in performance resulting from a force majeure event (including strikes, natural disasters, transportation disruptions, etc.).

10. Personal Data

Customer data is collected and processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable data protection laws.
Such data is used solely for order processing, delivery, and customer follow-up.

11. Governing Law and Dispute Resolution

These GTC are governed by French law. However, this choice of law shall not deprive the Customer of the mandatory consumer protection provisions applicable in their country of residence within the European Union.
In the event of a dispute, the Customer may bring the matter before the competent courts of their country of residence within the European Union. In accordance with Article 14 of Regulation (EU) No 524/2013, the Customer may use the European Online Dispute Resolution platform to resolve disputes.
